Wildlife Crimes & Laws of Humans!

No wonder she can see wild animals with such clear vision in comparison to humans & she is a lawyer is one more aspect for me to choose her quote for this particular sharing, which deals with wildlife as well law! Our news media is very choosy while they write about wildlife, let me put frankly, any positive news about wildlife or awareness efforts in the real right sense (do take a note of right sense) or pointing out suggestions for improvisation in wildlife conservation never gets due space in their newspaper. Many so called big English daily covers articles of foreigners with their profile photos which speaks about climate change & wildlife at global level & I appreciate that but there are thousands of our very own Desi personalities which are doing wonderful job in this very country for wildlife conservation in their own ways but that never get covered in same space! We have so much of wildlife even around Pune (surprisingly yes) & we have to save that as protected forests like tadoba or kanha have their own threats but they have comparatively enough man power & money for the cause but it’s about the wildlife which includes habitats around urban or say so called developed human settlements which we call as cities, these are in grave danger & more focus must be given about the efforts which are being done or needed to be done by the news media & that’s not happening!

And when any small mishap happens in the forests or wildlife from so called wildlife tourists then the entire news media creates a ruckus like sky has fallen. I don’t say don’t point out mistakes in wildlife tourism, what I am saying is wildlife tourism is most essential for wildlife protection so let’s see that how we can promote in controlled way but more than that aspect need is to make people (aam janata) aware about greater threats to the wildlife which no media does neither the system which we call govt or law & this is my reason of sharing! I came across two news in recent, one was about some Hon. Court giving a verdict regarding Mandul snake smuggling or trade by which the arrested criminals (sorry persons) have been given clean-chit as there was not enough or proper evidence against them which could prove that these persons were guilty for the crime of snake trade. A clean cheat, when they have been caught with mandul snakes in their possession, at least that’s what the officials have claimed. And then there was one news about seizing of tiger skin by Mumbai & Satara police   where three men got arrested, & later it's said that it was a fake tiger skin so the charges were reduced to cheating & not wildlife trading act. And then there was news (just one more news) of a young leopard which got hit by some vehicle & died & the news said an inquiry is going on. Interestingly on the news above the leopard roadkill news, there was a news about a two-wheeler guy got hit & died on the very same stretch of the road by again some unknown vehicle but here the news said police has registered a crime under the act of death by negligent driving against the unknown driver & searching for the same! I am sorry for both the victims, the youth which lost life on two-wheeler & the leopard but in the case of the youth as he was a human police has filed case considering it not just an accident but death by negligence & on their own filed a complaint & definitely they will search the vehicle from footage of CCTV in surrounding (if any) or will make inquiries about any such vehicle & will try their best to catch the driver who hit the youth but I doubt about such efforts related to leopard who also met the same fate!

My such doubt about the system (read as law) which is blind or deaf or ignorant (I won’t yet say dead) towards the crimes where wildlife at large is involved, is my cause of sharing! As these are just two cases which are fresh where may it be snake or a leopard but some wildlife specie’s life has been slaughtered (that’s only word I can use) by a human & our enforcement system don’t take serious efforts is the only cause which makes other humans to dare or afford to neglect while dealing with these species, is my cause of sharing!  This is just a start as everyday human population in this country is increasing & land available for all of us is going to remain same & this means humans will keep encroaching the land which is shared by others species may it be our homes, industries, means of transportation (road/ railways/ waterways) or power lines or any such & in the process of our negligent land use we will keep killing every that specie which comes in our way. And because these species are not humans, our laws either don't protect their interests properly or we don’t care to follow those laws, is my direct accusation on the entire society of humans & this must be stopped is my demand, not just a request or appeal! And if you think (I know you do think so) I am a fanatic or a mad wildlife lover then I am not, apart from above two examples I can give you hundreds (thousands or infinite) examples where no justice or little justice has been witnessed when its life of a wildlife species vs a human culprit! May it be life loss of thousands of fish to due oil spill from some ship or because of pollution of river by some industry or poaching of wild boar  for its meat or deaths of tigers & leopards under speeding vehicles (I am not even counting monkeys & jackals type animals)  or an elephant being electrocuted by some electric (illegal) fence, in all such cases tell me how many humans have been sentenced to death or even imprisoned for life time or has to pay millions of rupees as penalty, I don’t remember a single, now tell me am I a fanatic ? It's only because these animal lives we don’t count (accept it) neither they can vote nor they have any representative in the Assembly to shout for death of their types nor they can gather crowd for some procession & hunger strike they cannot as they are already dying because of hunger as food loss of their habitats which we turn a blind eye on, so what a tiger or a fish or snake or a leopard should to  get justice for his family members death by negligence or deliberately, by a human, tell me please humans!

The only way is, changing the laws related to wildlife crimes, make provision for heavy punishments for loss of wildlife & before that make a system which will be able to execute these laws in the right way as often the stringent laws end-up in making more casualties than the reason these laws are made for, if wrongly handled! A major problem with wildlife protection laws is, only if the crime is in the forest dept’s jurisdiction i.e., some reserved or protected forest they have rights or authority to act (I may be wrong but that’s what has been experienced) but mostly when the crime is outside some forest then the forest dept is dependent on police dept’s support or help which the later one is not much interested for obvious reasons! These reasons are not the ones which you are thinking (Do I need to explain!), but because already police dept is overloaded with crimes of the humans by the humans against the humans & on top of it solving murder mystery of some leopard or a snake is not priority for them! And another is, to prove a crime against some wild animal that too usually happen away from human eyes is not an easy thing to prove in the court, which makes usually the culprits get freed by the court (as in mandul smuggling case verdict) & the efforts are not worth is the thought process by most police staffers! Need of the time is like the Military has their own Police with enough powers by law & by infrastructure as well Police dept also has layers for different crimes, forest dept must have a crime investigation branch in it! This branch must have powers like Police once the crime is reported under some specific sections of law & they must be given all the necessary authority as well supported by their own dept to detect the crime, catch the criminals & see that these criminals get punishment under the court of the law. One more thing we can think of having separate wildlife courts at every District level as these crimes needs special knowledge as well a mindset to detect & don’t forget the skill required to make the case stand in right way of the law which many police officers, lawyers defending govt or even the magistrates (with due respect) may not be having, resulting in criminals getting free, only because of poor knowledge of the wildlife!

I agree wildlife can be protected in best possible way by making humans adopt coexistence but to teach coexistence we need a strong law enforcement system for those who don’t follow the laws because even coexistence among humans also neds a law system, right?  I know this also, in a country where courts for humans are itself insufficient (number of judges), law-enforcement system for humans is poorly equipped & is ever complaining over insufficient infrastructure (police dept), the IPC i.e. Indian Penal Code itself needed to be revised for many crimes & many such, so, who is going to think to change or rewrite the system for some wild species which hardly makes any difference to human life! But then do mind, we are not alone on this planet neither this planet is only for our exclusive use & if we are thinking so & feel nobody is going to stop us, then there is something named nature & even our law system accepts the term “Natural Justice”, as someone is out there which is too big for us to control & when it will deliver its verdict for the crimes we are ignoring then there won’t be any appeal but only execution, mind it humans & be responsible towards the wildlife crimes before it’s too late; adios with this threat, not warning!

What is the Right Time to Buy My Home!

Well, these quotes may give you feel that this sharing is about philosophy (it is but in different aspect) as right time is something we all crave for & then ironically, I am a fan (die-hard fan, follower everything) of Zen philosophy where there is no such thing as wrong time as in nature everything happens in whatsoever way happens at right time only! But then why everybody keeps speaking about the right time is a big question, as have a look at these conversations, is this not the right time to buy gold or this is the right time to buy a car or now is the right time to marry for you & many such, sound families?  Our life is revolving around this right time thing as often one’s success he may not credit to the right time but any failure one always blames to this right time, is what we all witness (and we also contribute to it) all the time! So, how the real estate industry i.e., home buying, which is the biggest buy or thing happening to any human (apart from marriage) can keep away from this right time syndrome & this is why the quotes about right time! Now coming back to the subject of rightness, as I was working on a series of right things in the real estate i.e., right home, right location & the next topic on my mind was right planning of a home but in between I came across one interesting question & that made me to change my sequence of the episodes m just the way current trend in Hollywood is! Confused, you must me but that’s how most movie watches becomes when they have to watch a prequel to sequels means part of movie before the first part has been introduced for e.g., after Bahubali part one movie (Well, plz don’t ask what is this) came Bahubali part two but now imagine if third movie is about a story which happened before Bahubali one started, that’s is a prequel! Same way this sharing you can consider as a prequel of Right Home sharing as the question was asked to me by a friend who is a successful fitness trainer with his wife also having a decent job & both aged nearing forty! He asked, is it a right time to buy a flat (read as a home) for him, as presently he stays in a rental flat in Kothrud (a western suburb of central Pune) & buying a flat nearby for which he has to take loan of at least Rs 70 lakhs & that means his rest all working life (twenty odd years) will end up paying EMI only. Instead, at present if he continues to stay in a rental home & keep aside the savings which was meant to be to pay as EMI & later some ten years go to buy a flat, won't it be a right time then?

His question was logical (the present generation is logical, when its about their interests) & logic is the second thing I respect most after someone’s trust in me, so the question made me think that my first sharing actually should be “What is the Right Time to Buy a Home”, as that is what starts rest all things about deciding a Right Home, right? What I told him, will share that first then will take on the topic at a general scale as first every one’s right time can be different depending up on his or her vision towards their respective future is what my personal opinion! So, I said Dost, decide what makes you comfortable as no wrong is living in a rental home but, many people feel its like living under a hanging sword as the landlord may raise rent or may decide to sell his flat at any time post your eleven months live license is a fact. Then shifting as well as being able to get a flat in the same locality to adjust your as well family’s routine in a new place is a big hassle but if you are going to get assured of the same place (rental home) for ten years then no harm. As if that’s case then one more thing, whatever ren you pay is going to be increased steadily & not sudden because presently (and in near future) considering the rampant re-developments in & around central Pune , rental flats are in huge demand because of shifting of re-development existing residents & they can may much higher than real needy rental people as for them it’s the builder who is paying rent & for the builders its part of his project expense which he is going to recover from his flat sale so he won't mind & the real rental tenant in the process has t end up to compete with higher rent rates which is a loss for him! And this trend will increase for next five years as every alternate society is under redevelopment whereas rental flats are not available in that quantity so rentals will be on a higher side for sure!

And even if you are able to bare that rent then the savings you will be keeping aside will be in FD or Mutual funds & about later aspect I am not expert so I won't comment but FD rates are going to go down while the property rates even if keeps increasing in moderate way (just like any other commodity) still that’s more than the interest rates, whenever you will decide to buy a home in developed suburb like the one you are staying right now, the savings & rate that time won't match is my logic!  But then what you say is also correct that is it worth to buy now & keep paying EMI forever, so, what I will suggest is keep staying in rental home for next five years & buy a flat in half price of what you are getting around at a location where you will get such but developed one (read episode 2, right location, lol) & ready possession only. This will work in three ways, one your EMI burden will be half, this ready possession flat you can give on rent which will make EMI burden to near quarter & five years down the line when you are sure of your course of career as well your child’s career too, then if you decide to settle at some location, sale the flat you own which will definitely fetch you more than what you have invested & that will make your then loan amount nearly half of what you will have to avail today so the EMI will be bearable & that’s all! This is what I say is the right time for you to buy a Home now also & then also, all that matters is what life you want to live, as that only decides a right time for you to buy a home!

Here many (most) readers will say, “aa gaya apani jaatpar” (it’s just a saying i.e., showing true colours of a builder, nothing to do with caste system) as means you are asking to buy a home now also & later also, that’s what a builder will always say! Well, if you feel so, then I am sorry, you haven’t understood what I said to conclude the chat with my fitness trainer friend, I said, its you who will decide what is the right time for you to buy a home as nobody else can define it for you. All I can do is, to tell you pros & cons of your decision to decide a right time because no more owning a home is a necessity which it was earlies for your social needs as well it should not be a liability (read as EMI burden) for you but it must make you feel comfortable by mind & that’s something is directly linked with your finances as well lifestyle, so the right time also you only can decide to buy that home! And if you apply this logic to every individual person or family which wants to buy a home then you will find different times considering the stage of life, they are in to buy their own home as right time & nothing wrong as there can be different homes also & each of that home can be right at the different timeline as even a rental home is to be owned by someone right?

And it's just matter of time in central or say developed part of Pune buying a home can be an investment for rentals the way it’s been in cities like New York or London, thanks to ever decreasing interest rates on FDs’ of nationalized bank as I won't comment on private banks, its again individual’s choice as well I am civil engineer & not a finance guy! Now, coming to the larger spectrum of right time of buying a home then one very basic fact remains, if you have already decided to settle in Pune as your career destiny then earlier the better as Pune’s land is limited so as your earning years but if you are not sure about where to settle yet & are ready to sail in “uncharted waters” (thanks to my latest watch Little Mermaid of Disney for this verb)  for a while then o harm in delaying your decision of buying  a home for living & you can always buy a home for investment till then if you are not comfortable with any other avenue for your savings!

Coming to right time for buying a commercial property, here I can give my own example as some eighteen years back when I started my own business then I wasn’t sure how it will grow (read as survive) & this happens with any entrepreneur so I chose to operate from a rental premise but when it was time to decide I didn’t wasted much a following to “Leap of Faith” (thanks, this one is from Spider Man in the Spider verse) I find my right time & bought my office premise though it was a costly deal then but in the time which followed it happened to be right decision because later when I had money there was no space available at the locations where I was comfortable to have my work place that’s why I hit the right time for my office space deal! What I will share with office space buyers, wait just to understand your needs as then only will be the right time for your buying office space. But if you intend to buy a commercial space for a shop i.e., across the counter trade & are clear about the location as well purpose of the shop then sooner the better will be your right time as rentals will be only delaying your chances of owning your own shop at right location, is my advice!

To conclude I will say, the right time to buy your home is something directly related to your own comfort level which nobody else can define for you but if you apply the right logic then you can decide the right time to buy a home for you & that is the key to your mental peace forever, for sure!

Pune, Growth & Gadkari !

Heath Buckmaster is a Marketing, Fundraising, and Business Development consultant, and an American Author of Young and Adult Fiction. Ok, leave apart Adult Fiction part of Heath’s career but what he wrote about becoming someone which may have been written in the context of a person but is applicable to many things even a city! And why I remembered Heath’s this quote is none other than our Hon. Transportation (roads) Union Minister, Mr. Nitin Gadkari!  Now we all know Nitin bhau (will take liberty of calling him with this fondly nick-name with my own roots from our common native place i.e., Nagpur) is man of mission & has done herculean task of building roads in this vast country with population touching 150 crores but what is it with change of personality & city, where is the connection, I can see the frowning faces of the readers!  Well, the reason is, recently Nitin bhau was in “aapale” (our) Pune as a Chief Guest of one of the Builder’s Association’s (Credai Pune) meet & the subject was real estate & role of infrastructure, as roads are one of the major infrastructure fronts for any country & so is real estate (though real estate never got glamour or credit for it, is different aspect) & who better than person like Nitin bhau can be there to speak about these two aspects which are growth engines of any country!

So, Nitin bhau came & spoke & living by his own way, “sidhi baat no bakwas” (strait from the heart) he bluntly said enough of buildings in Pune & the developers (read as builders) must look building homes beyond Pune, target villages in Western Maharashtra as the farmers here have good money & if builders build nice homes in their villages that can be win-win deal. As well, the builders should give away age-old methods of construction, must take support (not advantage) of new technology to reduce construction cost so home prices will be in control (of whom is another question). And he added, associations of builders should join hands with institutions like IIT for innovations  as well for R & D in the construction industry benefitting the end users i.e., home buyers. Nitin bhau also commented on the changed scene (read as condition) of Pune, how polluted it has become & what this city was meant to be & what it has become today & we need to take effort to give Pune its old charm. He also announced that nearly Rs 50,000 crore plus fly-over/ road networks will be built in & around Pune to reduce traffic congestion but that’s not the solution. He questioned (to whom) why there isn’t New Pune built by now as there is New Mumbai, around Mumbai & NOIDA around Delhi & why Pune is getting saturated in its existing form & yet people all around wants to come & settle here & why other regions are not getting developed (read as Nagpur) & things like that! First of all, what Nitin bhau said is true about Pune’s pollution or growth but keeping due respect, all these suggestions or questions he raised should have been asked to his own people or say Govt which is responsible for the way Pune is being developed & builders are just a pawn in this game, this is the reason of my sharing!

Nitin bahu, I must thanks to you as at least you openly mentioned the way things are happening around Pune & yet the city is preferred by many for their dream home, but who is at fault or blame, is subject of debate but let’s focus on the issues you have raised about Pune & builders as well other regions including Western Maharashtra Villages too, as maybe we can come up with some solutions which you only can use for the change! So, about the builders looking beyond Pune aspect, let me take you some forty odd years back when Pune was a city (but then all other cities today were towns or villages then) & if I remember even Nagpur was bigger than Pune on size, spread & trade then. Indeed, Pune has always that education aura but we all know what value education has in our country even today (barring getting a job) & Pune was used to be Pensioner’s Town (not even city). All people knew about Pune was, Chitale bakarwadi, 1pm-4pm shops are closed here & Pune 30, i.e., Sadashiv Peth resident’s attitude, that’s all! Suddenly something happened in 70’s-80’s & entered Bajaj-Telco & the train named Pune has started. Nitin bhau, I am just  a Nagpurian like you & trust me, most people barring a few (many of them are builders now in Pune) didn’t realized that this Maharashtra Express will become Vande-Materam Super-Fast train, in just four decades, this is what happened to Pune, & whose job was it to identify the speed of this train & make necessary changes to accommodate it as well to make other passenger trains to become express i.e. make other regions also grow! It was govt’s job but neither any govt nor opposition ever realized the potential as well speed of Pune’s growth & that’s why they have no role in what Pune has become today on growth front. Neither there is role of even builders or any segment of Pune’s trade or society as everybody did what it can do best i.e., keep getting benefitted from this train & this is why no segment especially the builders can be blamed for pollution or whatever bad state you feel Pune is in & that also I personally defer on!

Nitin bhau, indeed Pune’s pollution (air, river) & traffic jams is matter of concern but if you feel these are bad things about a city or a society then bhau, let’s go to Kolara, a village near our beloved tadoba forest as here you won’t find any pollution  as its forest but what you will find is pungent smell of human excreta & garbage on every approaching road of every village here, that too is pollution & whom we will blame here, as there are no builders here to blame! Everybody in Pune has contributed to its growth just by doing what he or she knows to do best, that’s how fate of cities is made unless the govt takes itself in driving seat & guides this fate which in Pune’s case didn’t happen. It was the govt (whichever it may be) which planned & announced New Mumbai & Noida developments & then the builders followed as in town planning (or in anywhere in real estate) builders just follows what govt decides about a region or the city, I think you missed that aspect of real estate! As town planning is not just planned roads, Development Control rules, water supply, or drainage system & public transport but it’s about environment & culture too, as well attitude of the people & this is where all other regions were left behind in comparison with Pune, is a big fact in the growth of the Pune region. And there do exists New Pune, just the fact is that is not officially declared by govt, as ask any die-hard Punekar (Pune 4 or Pune 30) he won’t accept Wakad or Pradhikarn or Fursungi or Ambegaon or Kharadi as Pune, yet a person buying home here thinks & accepts all these locations as Pune, this is what matters for the real estate! 

Coming to the technology part of construction industry & joining hands with institutes like IIT’s again you are at Bull’s Eye but “who will Bail the Cat’, is the question! Definitely, real estate segment needs to be united which is happening but then these things come with recognition & recognition comes only with respect which nobody pays to real estate is a fact! Nitin bhau, you are wonderful as an individual as first time a person of your stature from govt has addressed some association builders & touched the pinching issues though it’s not your industry but never any Urban development chief may it be of State or of Central has ever given time or attention towards Pune’s issues & that’s main cause of deterioration of this city! Real estate hasn’t been even acknowledged as an industry making taxes like GST at its worst here & policies are a mockery as for a ready possession home there is no GST but 12% GST on a home in making, what kind of policy is this! Same thing is about many essential ingredients & then, who has stopped IIT’s which are governed by the govt only, to start research wing focused on construction industry & materials at their end, real estate world will happily join hands, I am sure but it can’t be done vice versa, right? Though this is something real estate bosses must do about is I am writing from decade, lets hope your words will make the process a fast! As well a lot of savings can be done in the construction costs only if the rules & regulations governing the real estate (DC rules) are made in tune to accommodate the changes in the construction. Here one dept considers height of the building from habitable floor & another dept measures height of the building from road level & these types of jokes are keep happening making developers always in the dark about actual costing of the project till it gets completed! On one side you are saying to decongest Central Pune & on other hand UD dept is hell bend on increasing density around Metro track by making homes (Flats) smaller in the Central Part of the Pune which directly increases construction cost, just to make Metro in profit! Here, also you can put your weight on the concerned depts’ to take some brains in real estate in confidence for making policies which will help the masses only! One important aspect is, making Development Plans & implementing them in specific time, that itself will reduce construction cost like anything as millions of sq ft lands builders have to hold just for getting DP sanctioned, the interest on this investment is the main reason of increased rates of the homes!  And this list is bigger than Hanumanji ki Punchh but I am very happy & thankful you dared to open the dialogue on such sensitive issue!

Lastly, indeed the builders must take in consideration what you said about entering in hospitality (eateries) & tourism, as in Pune its very much important as these two things goes in hand with the growth as well margins in real estate are reducing & one can’t be dependent on them, especially with current policies of UD about Pune!

Nitin bhau, to conclude all I will share is, I too am also a diehard Vidarbhian like you but why people from our region or even from rural parts of Western Maharashtra are settling in Pune is not because they love Pune or this city offers them something out of the world, but because their respective native places can’t provide them very basic necessities of the life such as job, education, public health or even drinking water & this is no fault of any Punekar, definitely not of the builders in Pune but its failure of a system we call Govt (may it be of any political party’s), this is what we all has to accept if we want to give back Pune its glory & we are with you in that task, is I can assure!
